1. Introduction and Acceptance
Welcome to mmm...dating, a dating and relationship platform operated by SNJ Global PTY ("we", "us", "our"). By accessing or using the mmm...dating platform, mobile application, or any associated services (collectively the "Platform"), you agree to be bound by these Terms and Conditions ("Terms").
Please read these Terms carefully before creating an account. If you do not agree to these Terms in their entirety, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and SNJ Global PTY. We reserve the right to update these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We will notify users of material changes via email or in-app notification.
2. User Registration and Eligibility
2.1 Age Requirement: mmm...dating is strictly intended for adults. You must be at least 18 years of age to register for and use this Platform. By creating an account you confirm that you are 18 years of age or older. We reserve the right to terminate any account where we have reason to believe the user is under 18 years of age.
2.2 Account Registration: To access the Platform's features you must create an account by providing accurate, current and complete information.
- Provide truthful and accurate information during registration.
- Keep your account information up to date at all times.
- Maintain the confidentiality of your account password.
- Do not share your account credentials with any third party.
- Notify us immediately at support@snj-global.com if you suspect unauthorised access to your account.
- 2.3 One Account Per Person: Each user may maintain only one active account on the Platform. Creating multiple accounts is prohibited and may result in the termination of all associated accounts.
- 2.4 Account Responsibility: You are solely responsible for all activity that occurs under your account. SNJ Global PTY accepts no liability for any loss or damage arising from your failure to maintain account security.
3. Platform Mission and Community Standards
3.1 Our Mission: mmm...dating exists to foster genuine, meaningful human connection. Our platform is dedicated to encouraging long-term relationships, personal growth, and emotional wellbeing. We actively discourage casual encounters and hook-up culture. By joining mmm...dating you acknowledge and respect this mission.
3.2 Prohibited Conduct: The following conduct is strictly prohibited on the Platform. Violation of these standards may result in immediate account suspension or termination:
- Posting false, misleading, or fraudulent profile information.
- Impersonating another person or using another person's photos without their consent.
- Engaging in harassment, bullying, threatening, or abusive behaviour toward other users.
- Sending unsolicited sexually explicit messages, images, or content of any kind.
- Soliciting money, financial assistance, or gifts from other users.
- Promoting, facilitating, or engaging in any form of commercial sexual services or escort services.
- Using the Platform for any commercial, advertising, or promotional purposes without prior written consent from SNJ Global PTY.
- Attempting to circumvent or manipulate the Platform's verification systems.
- Sharing another user's personal information without their explicit consent.
- Engaging in discriminatory conduct based on race, gender, religion, nationality, disability, sexual orientation, or any other protected characteristic.
- Uploading content that contains malware, viruses, or any other harmful code.
- Using automated tools, bots, or scripts to interact with the Platform.
3.3 Content Standards: All content you post on the Platform including profile photos, bio information, and messages must be accurate and truthful, must not infringe third-party intellectual property rights, and must not be sexually explicit, pornographic, obscene, violent, hateful, discriminatory, or unlawful.
4. Profile Verification
4.1 Verification Requirement: mmm...dating uses facial recognition and liveness detection technology to verify that profile photos represent the real user. Profile verification is a mandatory step during onboarding. Unverified profiles may have limited access to Platform features.
4.2 Biometric Data: The verification process involves the collection and processing of biometric data including facial recognition data. By completing the verification process you consent to:
- The capture of a live video selfie for liveness detection purposes.
- The comparison of your live selfie against your uploaded profile photos.
- The storage of your verification status and confidence score in our secure database.
- The processing of your biometric data by our third-party verification service provider AWS Rekognition.
Biometric data is processed solely for identity verification purposes and is not used for any other commercial purpose. You may request deletion of your biometric data at any time by contacting us at support@snj-global.com.
4.3 Verification Limitations: While we take reasonable steps to verify user identities, SNJ Global PTY does not guarantee the accuracy of verification outcomes and accepts no liability for interactions with users who have circumvented or manipulated the verification process.
5. Subscription Tiers and Billing
5.1 Free and Paid Tiers: mmm...dating offers Free access with limited Platform features, Premium with full chat functionality with matches, and Premium Plus with all Premium features plus access to Milo, the AI-powered Wingman feature.
5.2 Billing Cycles: Paid subscriptions are available on monthly and annual billing cycles. Subscription fees are published on the Platform and are subject to change with reasonable notice to users.
5.3 Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. By subscribing you authorise SNJ Global PTY to charge your nominated payment method on a recurring basis until cancellation.
5.4 Cancellation: You may cancel your subscription at any time through your account settings or by contacting support@snj-global.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have already paid.
5.5 Refund Policy: All subscription fees are non-refundable except where required by applicable law. SNJ Global PTY reserves the right to introduce a formal refund policy at a future date, which will be communicated to users via the Platform. In exceptional circumstances refund requests may be considered at the sole discretion of SNJ Global PTY.
5.6 Price Changes: SNJ Global PTY reserves the right to modify subscription pricing at any time. Existing subscribers will be given reasonable advance notice of any price changes before they take effect.
6. Milo - AI Wingman Feature Disclaimer
6.1 What Milo Is: Milo is an artificial intelligence powered conversation assistant available exclusively to Premium Plus subscribers. Milo is designed to suggest personalised opening messages and conversation starters to help users initiate meaningful connections with their matches.
6.2 Nature of AI Suggestions: Milo's suggestions are generated by an artificial intelligence model and are provided for informational and assistive purposes only. By using Milo you acknowledge and agree that:
- Milo's suggestions do not constitute professional relationship, psychological, or therapeutic advice.
- SNJ Global PTY does not guarantee the accuracy, appropriateness, or success of any suggestion generated by Milo.
- You are solely responsible for the messages you choose to send to other users regardless of whether they were suggested by Milo.
- Milo may occasionally produce suggestions that are imperfect, inaccurate, or not suited to your specific situation.
6.3 Milo's Values and Restrictions: Milo has been designed to reflect mmm...dating's mission of fostering meaningful, long-term connections. Milo will not generate sexually explicit, crude, or hook-up-oriented suggestions under any circumstances. If a user attempts to use Milo in a manner inconsistent with the Platform's values, Milo will redirect the interaction toward meaningful connection.
6.4 Data Processing by Milo: To generate personalised suggestions Milo processes limited profile data including age, location, biography, and Table Manners selections of your match. This data is processed by our AI service provider Anthropic. By using Milo you consent to this processing. Please refer to our Privacy Policy for full details.
6.5 Availability: Milo is provided on an as-available basis. SNJ Global PTY does not guarantee uninterrupted availability of the Milo feature and reserves the right to modify, suspend, or discontinue Milo at any time with reasonable notice.
7. Privacy and Data Protection (POPIA)
7.1 Our Commitment: SNJ Global PTY is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and, where applicable, other international data protection frameworks including the General Data Protection Regulation ("GDPR").
7.2 Information We Collect: We collect identity information, contact information, profile information, biometric data, usage data, payment information, and anonymised AI interaction data from Milo sessions.
7.3 How We Use Your Information: Your personal information is used to create and manage your account, verify your identity and prevent fraud, provide and improve Platform features including Milo, process subscription payments, communicate with you about your account and Platform updates, ensure compliance with these Terms and applicable law, and protect user safety and Platform integrity.
7.4 Your Rights Under POPIA: As a data subject under POPIA you have the right to access your personal information held by us, request correction of inaccurate information, request deletion subject to applicable legal obligations, object to processing, and lodge a complaint with the Information Regulator of South Africa. 7.5 Third Party Data Processing: We engage AWS Rekognition for biometric identity verification, Anthropic for AI processing for the Milo feature, Supabase for secure database and file storage, and Vercel for Platform hosting and infrastructure. All third-party providers are contractually bound to process your data only as instructed by SNJ Global PTY and in accordance with applicable data protection law.
7.6 Data Retention: We retain your personal information for as long as your account remains active or as required by law. Upon account deletion your personal information will be removed from our active systems within 30 days, subject to any legal retention obligations. Biometric data will be deleted promptly upon account deletion or upon request.
7.7 International Data Transfers: As a global platform, your personal information may be transferred to and processed in countries outside of South Africa. Where such transfers occur we take reasonable steps to ensure appropriate safeguards are in place in accordance with POPIA and applicable international data protection standards.
8. Intellectual Property
8.1 Our Intellectual Property: All content, features, functionality, design, trademarks, logos, and technology on the Platform including the mmm...dating name, brand, and the Milo feature are the exclusive intellectual property of SNJ Global PTY and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without our prior written consent.
8.2 Your Content: You retain ownership of all content you submit to the Platform including profile photos, biography text, and messages. By submitting content to the Platform you grant SNJ Global PTY a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content solely for the purpose of operating and improving the Platform.
8.3 Content Removal: SNJ Global PTY reserves the right to remove any user-generated content that violates these Terms or that we determine in our sole discretion to be inappropriate, harmful, or contrary to the Platform's mission and values.
9. Limitation of Liability
9.1 Platform Provided As-Is: The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. SNJ Global PTY does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
9.2 Limitation of Liability: To the maximum extent permitted by applicable law, SNJ Global PTY and its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, goodwill, or other intangible losses, damages arising from your use of or inability to use the Platform, the conduct or content of other users, unauthorised access to or alteration of your account or data, or outcomes resulting from connections or relationships formed through the Platform.
9.3 User Interactions: mmm...dating facilitates connections between users but is not responsible for the conduct of users on or off the Platform. We strongly encourage users to exercise caution when meeting someone in person for the first time and to follow safe meeting practices. SNJ Global PTY accepts no liability for any harm arising from in-person meetings between users.
9.4 Indemnification: You agree to indemnify and hold harmless SNJ Global PTY, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another user.
10. Account Suspension and Termination
10.1 Termination by You: You may delete your account at any time through your account settings or by contacting support@snj-global.com. Upon deletion your profile will be removed from the Platform and your personal data will be processed in accordance with our data retention policy set out in Section 7.6.
10.2 Termination by Us: SNJ Global PTY reserves the right to suspend or permanently terminate your account at any time and without prior notice if we determine in our sole discretion that you have violated these Terms, harmed other users or the Platform, provided false or misleading information during registration or verification, engaged in fraudulent or illegal activity, or acted in a manner inconsistent with the Platform's mission and values.
10.3 Effect of Termination: Upon termination of your account for any reason your right to access and use the Platform ceases immediately. Subscription fees already paid are non-refundable upon termination for breach of these Terms. SNJ Global PTY reserves the right to retain certain information as required by law or for legitimate business purposes following account termination.
10.4 Appeals: If you believe your account has been suspended or terminated in error you may contact us at support@snj-global.com to request a review. SNJ Global PTY will consider appeals on a case-by-case basis but reserves the right to make final decisions regarding account status.
11. General Provisions
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
11.2 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SNJ Global PTY with respect to your use of the Platform and supersede all prior agreements and understandings.
11.3 Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
11.4 Waiver: The failure of SNJ Global PTY to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
11.5 Changes to These Terms: We reserve the right to modify these Terms at any time. Where changes are material we will provide at least 30 days notice before the new Terms take effect, either by email or through a prominent notice on the Platform. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
